As a child of divorce and after having taught severely emotionally disturbed children for many years I came to the law with a bias to act only in the best interest of children. I was really horrified to see how our adversarial system destroys families and divorcing parents ability to effectively co-parent after the legal battle was over. After being in private practice for 8 years I walked away in disgust, vowing to never take another adversarial case again and I haven’t. I have done over 300 divorce mediations and every single one has come to an agreement, in one day or less so I know mediation works. The average divorce case in California, when both sides have lawyers is $20,000 EACH! That is totally unnecessary and anyone thinking of getting a divorce really ought to look at mediation. Your children will thank you for having a peaceful divorce.

Education–A Top Priority Of Life

Each fall, school buses begin to roll and school bells start ringing. The beginning of another school year is once again upon us. This should be an exciting time for students. Their love of learning, the joy of spending time with friends, and the many benefits of this intellectual environment are great motivators. But, these are not the kind of students or parents for whom this article is written. That would be preaching to the choir.

In today’s complex, technological world, everyone needs a strong education to stay gamefully employed and achieve economic stability. To compete, one must be educated. Gone are the days when one could drop out of school and make a living. Yet, in many parts of this country that offers free educational opportunities, we still face double-digit dropout rates. It’s a sad picture that must change.

Parents play a pivotal role. They must emphasize the benefits and need for a good education. They must provide an environment that encourages learning. The process starts at birth and is best begun by example. Their actions should include reading to children and showing them the joy of learning. Their actions should nourish the natural tendency we all have to learn new things. Their actions should make the home a place where learning never stops.

The unfortunate truth is that too many parents don’t care. Young children are absent from school because parents are too lazy to get up and dress them. These children go to school unfed because fixing breakfast is too much of an effort. The home environment is negative and lacks encouragement towards excellence. There is no appreciation for the value learning brings to one’s life and the doors of opportunity it opens. There seems to be a perpetual push towards ignorance.

When I served on the school board, my most discouraging moments were when I saw a child walking the streets during school hours or late at night during the school week. These pictures are still daily occurrences in many communities. Their elimination would bring great joy to my heart. Today’s school dropouts are tomorrow’s societal burdens. They will not compete in the job markets. They are more likely to become the next generation of criminals.

Education should be the top priority in every family. Education should be the top priority in every community of this great nation and not a lip-service activity. That is the only way to break the cycle of poverty and dependence on government subsidy for a livelihood. Personal pride accompanies development of our mind. Discouragement accompanies ignorance.

Improving American Education Requires Family Law Reform

Proper drafting of a Property Settlement Agreement and Alimony provisions in a Property Settlement Agreement is beyond the scope of this article. The parental warfare also means that educational enrichment opportunities are fewer for them as their parents are paying their life savings to the divorce industry that is destroying their families and are so busy writing declarations, testifying, scheming, and/or defending against false allegations that they pay much less attention to their children. Although it is clear that many children of divorce suffer greatly in their academic performance, I am not convinced that it is marriage in and of itself that helps children be more successful. I suspect it has more to do with the children getting the benefit of two loving and involved parents along with their extended families who nurture, teach, socialize, and provide for the children in different ways. The benefits of increased economic resources also likely has something to do with the difference in results. When you compare cases such as divorce and custody, adoption takes a slightly lower percentage of cases filed. Adoption will deal with the rights of the child to be adopted, the rights of the real parents as well as those of the adopting parents. The interested parties are supposed to negotiate before a judge and reach an agreement that will be acceptable to all parties. The rights and best interest of the child in this case will be the ones that will have the first priority. Family law is one of those terms which is both descriptive and nebulous. So, what is family law? Actually, the answer is complex and simple at the same time. In Denver, as well as anywhere else in the country, there are several different areas that fall under the heading of family law. Lawyers can concentrate on more than one of these areas. In a nutshell, family law is the part of legal practice which covers domestic relations. These cover anything from marriage and divorce, to concerns of adoption and surrogacy, and also to issues including common law marriages and same-sex marriage. In Denver, as elsewhere, you’ll need a lawyer who has quite a lot of working experience in your precise area of need. Flagstaff Lawyers have the mandate of representing the law without prejudice. This means that they will represent either party of a Family Law issue regardless of which area of the law it pertains to. In other words if they are retained to seek custody the Flagstaff lawyers will put all of their legal experience to task to win the case. On the other hand, if they have been retained to prohibit custody then they will represent their client once again to the fullest extent that the Family Law allows. This is what is meant by Flagstaff Lawyers showing no favoritism. Everyone that has a Family Law issue is intitled to legal counsel of their choosing. Therefore, the Flagstaff Attorneys will put forth their best efforts in representing the needs of all clients in all areas of Family Law. From the Elkins website, “Throughout its work, the task force has sought input from individuals and organizations with experience and interest in California’s family courts, through focus groups, a survey of attorneys, and extensive opportunities for public input via the task force’s Web site, letters, and phone calls.” Developed by a 38-member task force, including several Sonoma County legal experts, this sweeping report is designed to increase access to justice for the thousands of Californians who appear before court judges. The problems which exist in California family court are legendary. Child custody is another important area of familial dispute. It is important to decide the right custody for the child/children. There are various things to decide in such a situation like – each of the parents responsibilities towards the child, the visitation of the parents after divorce, grandparent’s roles, and also the amount of alimony that the parent deserves. It is also decided under the family law whether the child needs any foster care. Despite this, you should ensure you take legal advice from a family law solicitor, or you risk not maximising the award you should receive. The Welfare Reform and Pensions Act is a complex piece of legislation and does create rights to make statutory instruments that give detailed law on how pension sharing works.

Family Affair: Youth Hunting and Hunters Education

Hunting is a time honored tradition in Michigan, and what better than to make it a family affair. Hunting provides Michigan families and individuals with millions of pleasurable hours of wholesome, challenging outdoor recreation. Most hunters develop an intense appreciation for the wilderness, wildlife and a clean environment through their participation in hunting. The challenge of becoming a sports-person becomes a lifelong quest. Most hunters know that the lasting fun of hunting comes only when it is conducted safely and ethically. Safe hunting begins with Hunter Education. Hunter education courses teach new hunters responsibility, ethics, firearm safety, wildlife conservation and wildlife identification, game care, survival and first aid. The typical hunter education course consists of two to five sessions with a total class time of 10 to 12 hours. Hunter education classes are typically held in outdoor clubs, schools, police stations, and camps. Since 2006 the State of Michigan has passed 2 new laws for the hunting seasons: one that lowers the hunting age and the other that creates an apprentice hunter program. The new hunting age law lowers the age for hunting game from 12 to 10 years old, and lowers the age for hunting deer, bear and elk with a firearm on private land only from age 14 to 12. Under the new law, other than on land where their parent or guardian lives, youth hunters must be supervised in the field by a licensed adult hunter who must maintain unaided visual and verbal contact with the younger hunter at all times. These new laws now let parents determine whether or not their children are ready to hunt. The apprentice program also gives adults who have not hunted before a chance to be mentored by an experienced hunter, so they can try the sport first before making a substantial commitment. The DNR encourages parents, guardians and other adult hunters to take a youngster hunting this year. In passing on an important heritage to a new generation of hunters, you also will be helping them learn valuable lessons about responsibility, outdoor ethics and wildlife conservation. The apprentice hunter program allows individuals to hunt without the required hunter education course if accompanied and closely monitored by a licensed hunter 21 and older who is mentoring them in the sport. An apprentice hunter may participate in the program for two license years before being required to take a hunter safety course. The Ten Commandments of Firearm Safety 1. Watch that muzzle! Keep it pointed in a safe direction at all times. 2. Treat every firearm with the respect due a loaded gun. It might be, even if you think it isn’t. 3. Be sure of the target and what is in front of it and beyond it. Know the identifying features of the game you hunt. Make sure you have an adequate backstop — don’t shoot at a flat, hard surface or water. 4. Keep your finger outside the trigger guard until ready to shoot. This is the best way to prevent an accidental discharge. 5. Check your barrel and ammunition. Make sure the barrel and action are clear of obstructions and carry only the proper ammunition for your firearm. 6. Unload firearms when not in use. Leave actions open/ carry firearms in cases and unloaded to and from the shooting area. 7. Point a firearm only at something you intend to shoot. Avoid all horseplay with a gun 8. Don’t run, jump or climb with a loaded firearm. Unload a firearm before you climb a fence or tree, or jump a ditch. Pull a firearm toward you by the butt, not the muzzle. 9. Store firearms and ammunition separately and safely. Store each in secured locations beyond the reach of children and careless adults. 10. Avoid alcoholic beverages before or during shooting. Also avoid mind- or behavior altering medicines or drugs. So, keep the time honored tradition alive, by getting the whole family involved in Michigan hunting.

Importance of Patient and Family Education Training: 5 Points

Patient and family education is an important responsibility of a healthcare organization. Healthcare employees who deal directly with patients help in informing them and their family members about everything related to the medical condition. Thus, it is essential that these employees are trained and given clear instructions on how to conduct this education. Patient and family education training helps the employees learn the needs of the patients and their families, which gives them an idea on what they know and don’t know. This way they will be able to plan how to get crucial information across to them. Another point to consider when educating patients and families is their culture, religion, language, and other beliefs. Timing when the information is shared is also significant. The training program covers all these topics and helps employees educate the patients and their families in an appropriate manner. It is the patient’s right to know about his or her condition and treatment. Properly educating patients and their families helps them make informed medical decisions and participate in the care of the patient. Education may be done in a casual surrounding when the doctors and nurses interact with the patient, and it can also be done in a formal surrounding during rehabilitation or nutritional therapy sessions. The standards and objectives for patient and family education have been established by the JCAHO or The Joint Commission on Accreditation of Healthcare Organization. Although the commission does not specify the exact constitution of the training program, they want the training to be as interactive as possible to promote maximum learning for patients as well as employees. It is clear that patient and family education training is very important. Here are some reasons why. • Once healthcare facilities understand the needs of the patients and their families, it enables them to improve their quality of care and increase efficiency. • Increase in healthcare costs is a growing concern for patients and their families. Appropriate education can help them save costs by informing them about their conditions and helping them with alterative options for costly treatments. • Education encourages better compliance to rules, as the patients now understand the reasons for those rules. Also, once patients are aware of their medical conditions and what the doctors are doing to help them, it makes them less anxious and more comfortable. • Patient education increases motivation, satisfaction, and compliance as it gets the patients involved in their own care and treatment decisions. • Previous research has shown that using resources and materials for patient education has significantly improved communication between patients and healthcare employees. There is no universal structure for patient and family education. The employees must customize the education pattern for every patient after considering their preferences and needs. Thus, you can see why patient and family education training is so important for employees. The training helps them become knowledgeable and develop good communication skills in order to deliver good patient education. Thus now you have the importance of patient and family education in a nutshell.

Benefits of Patient and Family Education

Patient and Family education is very essential as it gives patients an opportunity to become involved in their own care and make knowledgeable health care decisions. Several healthcare employees are involved in educating patients and their families. Patients are educated during casual interaction between themselves and their physicians or nurses. Other times, education takes place during specific services like nutrition or rehabilitation therapy and continuous patient care. As healthcare employees help in the education of patients and their families, it is important that they receive some sort of training. Patient and Family Education Training is aimed at giving the employees brief guidelines about how to educate patients and families. The first step in effective education is assessment of the learning needs of the patient and the family. Through this assessment, employees get an idea about what patients need to learn and how this can be best taught to them. Learning can only be effective when it is in accordance with the patient’s learning preferences, cultural and religious values, and language and reading skills. It is also essential that is given at the right time in a patient’s care process. All these things are taught to the employees in the Patient and Family Education Training. The Joint Commission on Accreditation of Healthcare Organizations (JCAHO) has set certain standards for Patient and Family Education which healthcare organizations need to comply with for accreditation. The standards do not specify any particular structure for this education. Their main objective is that the healthcare organizations must be able to show that the education philosophy they carry out represents education as an interactive course, wherein both patients and healthcare employees can learn something. Healthcare organizations now understand the benefits of patient education, including patient satisfaction and safety. Here are some important benefits of Patient and Family Education. • In the present-day healthcare situation, patient education can counter the increase in healthcare costs by lowering the expenses and enabling patients to understand and manage costly chronic conditions and treatments. • Patient and Family Education programs can help healthcare organizations improve the quality of care and produce better outcomes. • Education is effective in helping the patients and their families understand complex medical conditions, thereby increasing compliance to instructions and lowering anxiety levels. • Patient education through educational materials and resources has been known to improve health and improve communication between healthcare staff and patients. • Because patient education encourages patients to become involved in their own treatment decisions, it increases satisfaction, motivation, adherence, and empowerment. The content for patient education must be customized for each patient keeping in mind their specific needs and cultural preferences. Effective patient education results from the proven and comprehensive solutions that are set up by the healthcare organizations after a lot of thought, and integrated into the appropriate points in the healthcare delivery system. It is essential the healthcare professionals are trained about the proper approach to patient education. To educate patients and families effectively they should have sufficient knowledge of the subject, be willing to teach, and have good communicate skills.
